These terms and conditions outline the rules and regulations for the use of the website laperladiponente.com<\/em><\/strong><\/a><\/p>

Perla di Ponente<\/em> accepts credit cards and reserves the right to temporarily hold the amount before your stay. <\/p>

I. Scope of applicability<\/strong>
1.<\/strong> These Terms and Conditions govern contracts for the rental use of La perla di Ponente<\/em> apartments for accommodation, as well as for all other goods and services offered to the customer in this context (Accommodation Contract of “La Perla di Ponente<\/em>“).
2.<\/strong> To sublet the rented apartments, use La Perla di Ponente<\/em> apartments for purposes other than accommodation, for public invitations or other advertising purposes, for interviews, sales or similar events, the customer must obtain prior written consent from La Perla di Ponente<\/em>, which may also require payment of an additional fee.
3.<\/strong> General conditions to the customer are prohibited only upon explicit acceptance of this document.<\/p>

II. Contract conclusion<\/strong>
1.<\/strong> The contract comes into effect with acceptance by La Perla di Ponente<\/em> of the customer’s request. La Perla di Ponente<\/em> may, at its discretion, confirm the room booking in writing.
2.<\/strong> The customer is required to inform La Perla di Ponente<\/em>, without being asked, at the latest upon contract conclusion, if the use of one or more hotel services by the customer could jeopardize the normal operation of the hotel, the safety or reputation of La Perla di Ponente<\/em> in relation to public opinion.<\/p>

III. Services, prices, payments, compensation <\/strong>
1.<\/strong> The customer is required to pay the agreed prices for the apartments and other services provided. This also applies to services ordered by the customer directly or through La Perla di Ponente<\/em> provided by third parties and paid by La Perla di ponente<\/em>.
2.<\/strong> The agreed prices include all taxes and local duties in effect at the time of contract conclusion. This includes taxes required locally and payable by the guest according to specific municipal laws, for example the tourist tax. If the legal VAT changes or if local taxes are introduced, modified or abolished after these have been contractually agreed, prices will be adjusted accordingly. This applies only to contracts concluded with consumers, if the period between contract conclusion and fulfillment exceeds 4 months.
3.<\/strong> Perla di Ponente<\/em> may accommodate a subsequent customer request to reduce the number of booked rooms, hotel services or length of stay following a price increase for apartments and\/or other services.
4.<\/strong> If payment is agreed upon receipt, the receipt must be paid without any withholding and settled within ten days of receipt, unless otherwise agreed.
5.<\/strong> For each reminder in case of default, La Perla di Ponente<\/em> has the right to request payment of a penalty of \u20ac5. The customer is free to prove that La Perla di Ponente<\/em> has not incurred costs or has incurred lower costs. If the customer is not a consumer, La perla di Ponente<\/em> is authorized to charge the lump sum amount.
6.<\/strong> La Perla di Ponente<\/em> has the right to request from the customer a reasonable advance payment or guarantee, for example through credit card, at the time of contract conclusion. The amount of the advance payment and payment dates must be agreed in writing in the contract. For advance payments or guarantees for tourist packages, legal provisions remain unchanged.
7.<\/strong> In cases where this is justified, for example in case of non-payment by the customer or in case of extension of the contract object, La Perla di Ponente<\/em> has the right, even after contract conclusion, at the start of the stay, to request an advance payment or guarantee, as intended in point no. 6 above or an increase in the contractually agreed guarantee or advance payment, up to the total agreed amount.
8.<\/strong> La Perla di Ponente<\/em> is also authorized, from the beginning and during the customer’s stay, to request a reasonable advance payment or security deposit, as intended in point no. 6 above, to the extent that such amount has not already been paid based on what was previously defined in paragraphs nos. 6 and 7.9. Only the customer can compensate, reduce or cancel a claim by La Perla di Ponente<\/em> with an undisputed claim or one established with final effect in court. <\/p>

IV. Withdrawal by the customer (cancellation, annulment)\/non-use of apartment services (no-show) other applicable legal right of withdrawal or if La Perla di Ponente gives its explicit consent to withdrawal. <\/strong>
1.<\/strong> The contractual agreement regarding the right of withdrawal and consent to withdraw from the contract must both be in written form.
2.<\/strong> If a date has been agreed for free withdrawal from the contract, the customer may withdraw from the contract within a given account without having to bear any costs or damage compensation claims from La Perla di Ponente<\/em>. The customer’s right of withdrawal lapses if it is not exercised in writing with communication to La Perla di ponente<\/em> within the agreed term.
3.<\/strong> La Perla di Ponente<\/em> has the right to the agreed price even if the rooms are not used, if no contractual right of withdrawal has been agreed or if this right has expired, if the legal right of withdrawal or cancellation has not survived or been granted and if La Perla di Ponente<\/em> does not give its consent to contract termination. La Perla di Ponente<\/em> must credit third parties with income from renting the rooms, as well as saved expenses. If the rooms are not rented otherwise, La Perla di Ponente<\/em> may request the contractually agreed rate and determine a lump sum for saved costs. The customer is free to argue that the declared costs were not incurred or do not amount to the requested amount. <\/p>

V. Cancellation by La Perla di Ponente<\/em><\/strong>
1.<\/strong> To the extent that it has been agreed that the customer may withdraw from the contract without charges until a certain date, La Perla di Ponente<\/em> in turn has the right to withdraw from the contract, in whole or in part, until that certain date, if other customers request the rooms booked through contract and the customer, upon specific request by La Perla di Ponente<\/em> and within a reasonable term, does not waive their right of withdrawal. The same applies to granting an option in case there are other requests and the customer, upon specific request by La Perla di Ponente<\/em> and within a reasonable term, is not willing to make a definitive booking.
2.<\/strong> La Perla di Ponente<\/em> also has the right to withdraw from the contract exceptionally for a materially justifiable cause, particularly if force majeure or other circumstances independent of La Perla di Ponente<\/em>‘s will make contract fulfillment impossible or if La Perla di Ponente<\/em> services are booked with false or deliberately misleading information or by concealing essential facts. The customer’s identity or solvency or the purpose of their stay may be essential facts;
3.<\/strong> La Perla di Ponente<\/em> has valid reason to believe that the use of its services could jeopardize the normal operation of La Perla di Ponente<\/em>, its safety or its public reputation, without this being attributable to the organization or control sphere of La Perla di Ponente<\/em>; the purpose or cause of the stay is not legal; there has been a violation of clause I no. 2 above; an agreed advance payment or guarantee or advance payment required under clause III no. 6 and\/or paragraph III no. 7 is not paid even after the expiration of a reasonable term set by La Perla di Ponente<\/em>.
4.<\/strong> Justified withdrawal by La Perla di Ponente<\/em> does not give the customer the right to damage compensation claims.
5.<\/strong> If, in case of withdrawal under paragraph no. 2 above, La Perla di Ponente<\/em> requests damage compensation, La Perla di Ponente<\/em> may charge a lump sum for such claim. In this case, clause IV no. 3, paragraphs 2 to 5. <\/p>

VI. Apartment availability, delivery and return <\/strong>
1.<\/strong> The customer does not acquire the right to have specific apartments unless this has been expressly agreed. 6. Should individual provisions of these General Conditions for Accommodation Contracts of La Perla di Ponente<\/em> be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. Legal provisions also apply.
2.<\/strong> Unless otherwise agreed, booked apartments are available from 5:00 PM on the established arrival day. If a delayed arrival time has not been declared agreed or if the apartment has not been paid in advance, La Perla di Ponente<\/em> is authorized to rent the apartment to other customers after 7:00 PM, without the customer being able to make claims against the bed and breakfast on account of the action. There is no obligation to rent the apartment to another person.
3.<\/strong> Apartments for La Perla di Ponente<\/em> must be vacated by 10:00 AM on the agreed departure day. Should the customer wish to leave the apartment after this time, it can be arranged in advance by paying an hourly rate, based on availability.
4.<\/strong> If the customer uses the apartment after 10:00 AM without having previously agreed this with La Perla di Ponente<\/em>, the latter may charge 50% of the full rate (list price) for further use of the apartment until 5:00 PM (however not less than the amount referred to in the previous paragraph 3), after 5:00 PM at least 90 percent. The customer is free to provide that La Perla di Ponente<\/em> is entitled to a lower claim or is not entitled to any claim. <\/p>

VII. Liability of La Perla di Ponente<\/em> <\/strong>
1.<\/strong> La Perla di Ponente<\/em> is liable for damages to physical health, limbs and life. It is also liable for other damages caused intentionally or through negligence or due to an intentional or irresponsible violation of typical contractual obligations. Typical contractual obligations are obligations that require proper contract execution and on whose fulfillment the customer relies and can rely. Violation of La Perla di Ponente<\/em>‘s requirements is equivalent to violation by the legal representative or substitute attorney. All other damage compensation claims are excluded, unless otherwise provided in this clause. <\/p>

VIII. In case interruptions or deficiencies in services are found. <\/strong>
1.<\/strong> La Perla di Ponente<\/em> must remedy such interruptions as soon as it is informed or following complaints from the customer, without unjustified delays. The customer is required to take every reasonable action to eliminate the interruption and minimize possible damage. The customer is also required to promptly inform La Perla di Ponente<\/em> in case substantial damage may occur.
2.<\/strong> La Perla di Ponente<\/em> is not liable to the customer for items brought to the hotel according to legal provisions. Use of the in-room safe is recommended. If the customer wishes to bring money, stocks, funds, bonds or other valuables worth more than \u20ac800 or other items worth more than \u20ac3,500, a separate custody contract is required.
3.<\/strong> Items forgotten by the customer are sent only upon customer request, at their risk and expense. La Perla di Ponente<\/em> holds these items for three months, after which, if any item has value, it will be sent to the local lost and found office. If your local lost and found office does not accept the items, they hold them for another month, after which they are disposed of or destroyed. Regarding La Perla di Ponente<\/em>‘s liability, what was previously defined in paragraph no. 1, paragraphs 1 to 5.
4.<\/strong> If the customer is assigned a parking space in La Perla di Ponente<\/em>‘s parking lot, this is not a custody contract, even if paid. La Perla di Ponente<\/em> has no surveillance obligation. La Perla di Ponente<\/em> assumes no responsibility for damage or loss of vehicles parked or maneuvering within La Perla di Ponente<\/em>‘s property or their contents exclusively under the previous point no. 1, paragraphs 1 to 5. La Perla di Ponente<\/em> must be immediately informed of any damage.<\/p>

IX. Final provisions <\/strong>
1.<\/strong> Modifications and additions to the contract or these general conditions must be made in writing. Unilateral modifications and additions by the customer are not considered valid.
2.<\/strong> For commercial transactions, the place of performance and payment is La Perla di Ponente<\/em>‘s headquarters.
3.<\/strong> La Perla di Ponente<\/em> may, at its discretion, sue the customer either at La Perla di Ponente<\/em>‘s headquarters or at the customer’s domicile.
4.<\/strong> The contract is governed by and must be interpreted in accordance with the laws of the Italian Republic. The application of the United Nations Convention on the International Sale of Goods and on conflicts of laws is not permitted.
5.<\/strong> La Perla di Ponente<\/em> does not participate in dispute resolution mediation by consumer associations.
6.<\/strong> Should individual provisions of these General Conditions for Accommodation Contracts of La Perla di Ponente<\/em> be or become invalid or unenforceable, this will not prejudice the validity of the remaining provisions. Legal provisions also apply. <\/p>
